1.  MARTHA JANE3 REYNOLDS  (JOHN2, HENRY1) was born abt. 1814 in Montgomery County, North Carolina, and died 1841? in Marshall County, Mississippi.  She married (1) JOHN CALVIN CHISHOLM.    She married (2) RICHARD WILLIAM BYRD 09 Aug 1836 in Marshall County, Mississippi.  He was born abt. 1817 in Alabama.

Martha Chisholm; Guardian to Daniel John Calvin and Mary Jane Chisholm, Minor heirs of John Calvin Chisholm, Deced, Appointed, in July 6th A. D. 1838.

 

State of Mississippi, Marshall County.  Known all men those present that-- Martha Chisholm and Michael Bird are held and firmly bound unto Hardy H. Whittaker Judge of Probate of Marshall County in the sum of four thousand dollars to be paid to the said Hardy H. Whittaker his successors in office as assigned and for which will and truly to be made we bind ourselves and heirs and jointly firmly by these present and----firmly by those present witness our hands and seal 6th day of July 1838

 

The above is part of several probate records, the first recorded on July 6, 1836 establishing when John Calvin Chisholm died.  The document was filed in probate court at Holly Springs on January 28, 1837.  During the appraisal of the goods and inventories of John Calvin Chisholm, totaling $3609.50, two notes were due to be paid to John Reynolds one for $767.00 due on January 1, 1837, and the other for $160.00 on January 1, 1838. John Reynolds is the father of Martha Reynolds Chisholm.  Three slaves are mentioned; Fred age 27, Ben age 16, and a girl age 11 are listed in the appraisal. Other goods were mentioned in the personal estate of John Calvin Chisholm.

 

The personal estate of John Calvin was willed to his two minor children; also no land or properties were mentioned in estate records. The land must have been deeded to Martha before his death. Martha married Richard Byrd a short time after Johns death.

2.  MARY JANE4 CHISHOLM (MARTHA JANE3 REYNOLDS, JOHN2, HENRY1) was born 17 Apr 1835 in Tennessee, and died 06 Feb 1872 in Galveston, Texas.  She married ASA EVANS STRATTON 30 Apr 1856 in Marshall County, Mississippi.  He was born 13 Jun 1798 in Athol, Worcestor County, Massachusetts, and died 22 Jul 1877 in Luling, Texas.

 

Notes for MARY JANE CHISHOLM:

Mary Chisholm and Daniel J. G. Chisholm are mentioned in the dispensation of the properties in John's will documents.

 

We find Mary J. Chism misspelled (Chisholm) on Page 216 of the 1850 Census of Marshal County, Mississippi living in the household of Mary Reynolds the wife of the John Reynolds deceased. Martha and John Calvin Chisholm have died. Mary Jane Chisholm age 15 is enumerated in Mary's household on page 216.

State of Mississippi, Marshall County

Know all men by these presents that we Martha Chisholm and Michael Byrd of the County aforesaid are hereto and firmly bound to Hardy H Whitaker, Judge of the Probate of Marshall County and his successors in office in the sum of four thousand dollars which payment will truly be made we bind ourselves, our heirs our Family------firmly by these unto witnesses our hands and seals this 6th day of July, 1836.

The condition of the above obligation is such that if the said Martha Chisolm Adminstrix of the goods, chattels and credits of John Calvin Chisolm deceased, do make a true and perfect inventory of all  singular goods, chattels and credits of the said deceased which shall come to the hands, possessions or knowledge of the said Martha Chisolm, or in the hands or possessions of any other person for her  and the -----shall be made an exhibit of the Probate Court of Marshall County where she shall be thereunto required by the said court and such goods, chattels and credits do well and truly administer according to sum and further do make a just and true account of her actings therein and  thereunto when  required by the said court and all of the rest of the goods chattels and credits which shall be found remaining upon the account of the said Administrix the same being first examined and allowed by the said court shall -------  -------pay unto  such respectfully as one entitled to the same by law and if it shall hereafter that any last will and testament was made by the deceased and the same be proved in court and the executor or executrix attain ----- and the said Martha Chisolm do in such case  being required reader and deliver up her letters of Administration then this obligation to be void else to remain in full force.

Guy, Edward Howell and William Davis Greetings: This is to authorize you t------------to appraise the goods chattels and personal estate of John Calvin Chisholm late of Marshall county deceased. So far as they come to your sight and knowledge each of you is to return---to an inventory of the said goods, chattel and personal estate by you appraised in dollars and cents and in the said inventory you are to let down in a column or columns  opposite to each article the value there of-----The honorable Hardy Whitaker, presiding judge of the Probate court of Marshall County this sixth day of July 1836. Given under my hand and private seal having no seal of the said court of Holly  Springs the 28th day of January, 1837.                                            (seal)

In accordance with a commitment to us directed by the Probate Court for the County aforesaid requiring us the undersigned to appraise the goods, chattel and personal effects of John Calvin Chisholm, deceased late of said county.

We, Leander Guy, Edward Howell and William Davis do swear that we will and truly without partiality or prejudice value and appraise the goods, chattels and personal estate of John Calvin Chisholm deceased so far as the same  shall come to our sight  and knowledge and will in all respects perform our duty as Appraisers to the best of our skill and judgment, so help us God. This the twentieth day of March, 1837.

The condition of the above obligation is such that if the above bound Martha Chisholm as to Daniel, John, Calvin Chisholm and Mary Jane Chisholm , orphaned and minor heirs of John Calvin Chisholm deceased of Marshall CountyŚ faithfully accomplished with the Probate Court of Marshall County as directed by law for the management and property under her care and the said property agreeably to the order of the said court or the directions of-- and shall in all respects perform the duty of guardian to the said Daniel, John, Calvin and Mary Jane Chisholm according to the law. Then the above obligation shall cease. (it shall otherwise remain in full force and virtue in law.)
